What is on this site

Worth establishing first, because it decides whether a notice is the right instrument. This site accepts no uploads, hosts no user accounts and publishes no photographs, video or audio. There is no user-generated content on it and no gallery of any kind.

What it carries is text, computed figures drawn from a price dataset, and 40 platform marks. Each mark is shown beside that platform's own name, at 64 pixels square, to identify the platform being written about. No mark implies endorsement by or affiliation with its owner.

If your notice is about a mark, say so and it will be removed on request and replaced with the site's own monogram. That is a one-line change and needs no argument about nominative use.

What a notice has to contain

Under 17 U.S.C. 512(c)(3) a notice must include all six of these. A notice missing one is not effective, and this is the whole list rather than a summary of it:

  1. A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. Where several works on this site are covered by one notice, a representative list of them.
  3. Identification of the material claimed to be infringing, with enough detail to locate it. A URL is enough and is what is wanted.
  4. Information sufficient to contact you: address, telephone number, and an email address.
  5. A statement that you have a good-faith belief that the use complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner of the right claimed to be infringed.

What happens next

A complete notice is acknowledged and the material identified in it is removed or disabled while it is considered. Removal is not an admission that the claim is right; it is what a notice is for.

Because this site is static and rebuilt from a dataset, removal usually means an edit to the source and a rebuild rather than a file being deleted from a server. That takes a build rather than a moment, and the acknowledgement will say when.

Notices and their outcomes are kept. Nothing about a notice is published and no notice is forwarded to a third party except where the law requires it.

Counter-notice, and misrepresentation

If material of yours was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address. It needs your signature, identification of the material and where it appeared before removal, a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification, and your contact details.

Section 512(f) is worth reading before either. A person who knowingly misrepresents that material is infringing, or that it was removed by mistake, is liable for damages, including costs and legal fees.

What this page does not claim

No designated agent has been registered with the US Copyright Office for this site, and no safe harbour under 17 U.S.C. 512(c) is being asserted. That designation requires a named agent at a physical address, published here and filed there, and it has not been made.

This is stated rather than left to be inferred from its absence. A procedure page carrying every element of a valid notice, an address and a response commitment reads like a safe-harbour designation in every particular and is not one, and a rights holder is entitled to know which they are looking at before they rely on it.

What the address above does is receive notices and act on them, which is the part that matters to somebody whose work is on a page that should not carry it. Nothing here is legal advice and nothing here waives any right or defence. Other routes, including the ordinary contact address, are not a substitute for a notice under this section.
